Definitions.
Specification means a draft or final version of the ISO/IEC (the International Organization
for Standardization / the International Electrotechnical Commission) International Standard
23008-12 "Information technology – MPEG systems technologies – Part 12: Image File Format".
Software means any source code, object code or binary files provided by Nokia that, when used,
fully or partly, generates files complying with the Specification and/or read files complying
with the Specification.
Necessarily Infringed means there is no technical means of implementing the Specification,
including implementation of any mandatory or optional parts thereof, without infringing such
claim of a patent.
Licensed Field means the non-commercial purposes of evaluation, testing and academic research
in each non-commercial case to use, run, modify (in a way that still complies with the
Specification) and copy the Software to (a) generate, using one or more encoded pictures as
inputs, a file complying with the Specification and including the one or more encoded pictures
that were given as inputs; and/or (b) read a file complying with the Specification, resulting
into one or more encoded pictures included in the file as outputs.
Licensed Patent means, excluding any Codec Patent, a Nokia Technologies Oy patent Necessarily
Infringed by the Software when using the Software within the Licensed Field. For the avoidance
of doubt, Licensed Patents are limited solely to patents implemented in the Software.
Codec Patent means a patent on image or video compression or decompression. Including, for the
avoidance of doubt, any standard essential patent on any coding standard, such as ITU-T Rec.
H.264, ISO/IEC 14496-10, ITU-T Rec. H.265, and ISO/IEC 23008-2.
License Grant.
Nokia Technologies Ltd (“Nokia”) hereby grants to you a non-sublicensable, perpetual, worldwide,
non-exclusive, no-charge, royalty-free, irrevocable (except as stated in this license) license,
under its copyrights and Licensed Patents only to, use, run, modify (in a way that still complies
with the Specification), and copy the Software within the Licensed Field. For the avoidance of
doubt the Licensed Patents shall not include Codec Patents. Codec Patent licenses are neither
granted, implied nor otherwise conveyed hereunder.
Termination.
If you, directly, or indirectly via a controlled affiliate or subsidiary, agent, or exclusive
licensee, file a Claim (as defined below) of patent infringement against any entity alleging
that the Software in whole or in part constitutes direct or contributory patent infringement,
or inducement of patent infringement (a “Claim”), provided that the Software also allegedly
infringes the patents asserted in the Claim, then this license, including any patent and other
rights granted to you under this license, shall automatically terminate retroactively as of the
date you first received the license grant.
No Warranty.
THIS SOFTWARE IS PROVIDED BY THE NOKIA AND ITS AFFILIATES "AS IS" AND ANY EXPRESS OR IMPLIED
WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS
FOR A PARTICULAR PURPOSE ARE DISCLAIMED. IN NO EVENT SHALL NOKIA OR ITS AFFILIATES BE LIABLE FOR
ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT
NOT LIMITED TO, PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES; LOSS OF USE, DATA, OR PROFITS; OR
BUSINESS INTERRUPTION) HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT
LIABILITY, OR TORT (INCLUDING NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY OUT OF THE USE OF THIS
SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.
