    Disclaimer of Warranties: The Software is provided "as is" without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and noninfringement. The entire risk as to the quality and performance of the Software is with the User.

    Limitation of Liability: In no event shall the Licensor be liable for any damages (including, without limitation, lost profits, business interruption, or lost information) arising out of User's use of or inability to use the Software, even if the Licensor has been advised of the possibility of such damages.

    Governing Law This Agreement shall be governed by and construed in accordance with the laws of the State of California.
