For slashing, a Jailed validator in the active (consensus) set will explicitly be removed from that set, but if it is in another validator set when the infraction is discovered, no action will be taken to remove it from that set.

When validator set updates necessitate promoting a validator into the active/consensus set, we must explicitly check the validator state to ensure that the validator should actually be promoted.
